How to Lodge an Appeal for a Declined SRD Application?

The SASSA SRD grant is one of the most applied-for grants in South Africa. There are other types of SASSA grants, like the Older Persons’ Grant or Disability Grant, but the SRD R370 grant is one of the best grants that was started in May 2020 to cater to unemployed citizens. However, every month, more than 8000 people apply for this grant, and only eligible people get the grant payment. If your SRD grant application status is declined and you want to appeal this issue, then you can do it on the DSD website.

If SASSA declines you, the appeal goes to the Independent Tribunal for Social Assistance Appeals (ITSAA). ITSAA is not part of SASSA. It is a separate body that reviews SASSA’s decisions.

How Long You Have to Appeal

The rule is that you may, within a period of 30 days but not exceeding 90 days, appeal SASSA’s decision to ITSAA.

Read that carefully, because it is the part most people get wrong. The clock starts on the day SASSA declined you. It does not start later, after some other outcome. If you wait more than 90 days from the decline, the appeal site will refuse it and the original decision stands.

There is also a second rule that costs people money: you must appeal each declined month on its own. One appeal does not cover your whole application. If you were declined for four months and you only appeal one of them, the other three stay declined.

This guide will educate you on how to submit an SRD appeal application online and how to check the appeal status.

Who is Eligible for the SRD Appeal for Decline Application?

An appeal only works if you actually met the rules for the month you were declined. Check yourself against these first.

Earning Less Than R624/month

Your income must be below R624 per month. If you earn more, your application may be declined.

Unemployed

You must not have a job or regular income. SASSA checks if you’re getting any salary or payments.

Not Receiving Other Grants

You should not be getting another SASSA grant for yourself, like a disability grant. A child support grant you receive for your children does not count.

Age Between 18 and 59

Applicants must be between 18 and 59 years old.

Permanent Resident or Citizen

You must live in South Africa legally.

How Long ITSAA Takes to Decide

ITSAA finalises an appeal within 60 to 90 days from the date the appeal was received. That is their published turnaround, so do not panic if nothing happens in the first month.

If the appeal succeeds, you are paid for that month.

What If ITSAA Also Turns You Down?

The tribunal’s decision is the end of the road inside the system. There is no further appeal to SASSA or to DSD, and nobody at either office can overturn it.

The only step left is a judicial review in the High Court, which must be brought within 180 days. That is a court process and it costs money, so most people would need a lawyer or a legal aid clinic.

In practice, if your circumstances have changed since the decline, a fresh application for a later month is usually the more realistic route.

About the Independent Tribunal for Social Assistance Appeals (ITSAA)

The Independent Tribunal for Social Assistance Appeals (ITSAA) is a separate body that reviews decisions made by SASSA. It was created to protect the rights of people who feel their social grant applications were unfairly declined, including SRD grant appeals.

ITSAA does not work under SASSA. It is fully independent. This means it can look at your case without bias. The goal of ITSAA is to ensure that everyone receives fair treatment and equal access to social support.

If your SRD appeal is rejected by SASSA, you can take your case to the ITSAA. You must submit your appeal in writing within 90 days after the rejection. Your appeal should clearly explain why you think the decision was wrong. Include all facts and documents to support your case.

ITSAA carefully reviews each case. It checks if the rules were followed and if your rights were respected. After review, ITSAA gives a final decision. SASSA must follow this decision.

F.A.Q

Can I appeal for each declined SRD month separately?

Yes, you must submit a separate appeal for every month your SRD application was declined.

What if I lost access to my registered phone number?

You need to contact SASSA to update your contact details before you can appeal or check your status.

How long does it take to receive a decision after submitting an appeal?

ITSAA finalises appeals within 60 to 90 days of receiving them.

I was declined more than 90 days ago. Can I still appeal?

No. Once 90 days have passed since SASSA’s decline, the appeal site will not accept it and the decline stands. You can still apply again for a later month.

Will I get back pay if my appeal is approved?

You are paid only for the months you appealed and won. A month you never appealed stays declined, so lodge a separate appeal for every declined month.
